We’re there if you need us. Mercedes-Benz Trucks Roadside Assistance and Service24h are available around the clock, 365 days a year, to get our customers back on the road.

Daimler Truck AG uses the “S24h App for Technicians” to organise the Roadside Assistance Service and Service24h.  In this data privacy statements, we inform you – as a technician at our authorised service partner and thus user of this application – how your personal data is collected and processed as part of the Roadside Assistance Service (incl. S24h), for what purposes and on what legal basis the data processing takes place and for how long we store your data. We also inform you about your rights and claims and how you can assert them.

1. The purpose of the processing
Our Roadside Assistance Service (incl. S24h) organises assistance in the event of a breakdown and also takes care of other matters relating to the Mercedes-Benz Trucks S24h Service. Our digital “S24h App for Technicians” supports you in providing and documenting your service as a technician.

We generally collect and process your personal data and that of S24h customers only to the extent necessary for the provision of a functional application and the provision/improvement of our S24h services and content. The data also serves us to optimise the platform and to ensure our IT systems.

If you provide us with further personal data, e.g. as part of a contact form, an e-mail or telephone communication, we will use this data exclusively for the purposes of communication and administration to the extent required for this purpose.

2. Processing of your personal data and data categories
a) Provision of the S24h app for technicians
The S24h App for Technicians can only be used with an authorised user ID. The following personal data is processed for the login to the S24h App for Technicians:

  • User ID of the user who uses the S24h App for Technicians (Business ID).
  • Last name/first name of the user who uses the S24h App for Technicians.
  • IP address of the device used to run the S24h App for Technicians.

b) Status, geolocation and service provided by the user
As part of the S24h service, the following personal data is processed within the application and transmitted to the central system for case processing:

  • Status display and case processing:

In the case of an active shift, the S24h App for Technicians calculates the user’s current availability status and displays it in colour. The shift can be ended manually by the user at any time in the application.

  • For an active shift, the user must select a telephone number from a list of fixed telephone numbers. The list of available telephone numbers is provided and maintained by the responsible service partner. The processing of the telephone number is necessary for the provision of S24h orders to the user and to be able to resolve queries to the user regarding orders.
  • The current availability status is highlighted in colours in the S24h App for Technicians. A “green” icon indicates that the user is available to receive new S24h cases (e.g., at the start of a shift). A “yellow” icon is present when the user is already working on a case. If the user manually enters an absence during the active shift, the status changes to a “red” icon within a period of time defined by the user.
  • Users without active cases or in the so-called “Master mode” sends the status “available”. Master mode can be activated manually in the settings as a general signal in order to be available for any number of cases.
  • S24h orders are dispatched based on availability status and geolocation.
  • After a case has been dispatched, the time stamps required for case handling are collected in order to document the service performance and to inform the respective customer of the progress.

Geolocation of the S24h App for Technicians user

  • In the default setting of the S24h App for Technicians, the current location of the user’s end device is transmitted.
  • This is absolutely necessary in order to be able to locate the nearest available service technician – based on the location of the requesting S24h customer – in the event of a Roadside Assistance Service (incl. S24h) order.

For this purpose, the user’s exact location is automatically updated and transmitted within the S24h App for Technicians every 30 seconds (maximum interval). If there is no movement of the end device used, the position is only transmitted every hour.

  • The exact position of the S24h App for Technicians user is transmitted by default. Optionally, it is possible to enter a “privacy mode” (available in the settings of the S24h App for Technicians).
  • In the so-called “privacy mode”, only a random position of the user of the S24h App for Technicians – within a radius of two kilometers – is transmitted.
  • No position is transmitted in the so-called “dealer mode”.
  • In addition, the user of the S24h App for Technicians can manually update the last transmitted position.
  • In principle, the geolocation is only transmitted during an active shift of the user (also during a planned absence during the shift).

 

c. Further application options
In addition, we process personal data for the purposes of safeguarding our legitimate interests as well as the legitimate interests of third parties, in particular for the following processing:

  • Maintaining the functionality of our IT systems
  • To improve our application
  • Creation of anonymised reports
  • For security reasons, in particular to prevent and detect attacks on our app or attempts at fraud, we store the information and user data for a period of 30 days.

3. Source of personal data in accordance with Art. 14 (2) lit. g DSGVO
User information for logging into the S24h App for Technicians

  • In order to use our services, you must first register on our platform. We use our own single sign-on process for registration.
  • User ID/Business ID: Used to log in to the S24h App for Technicians and to identify the responsible user. The basis for access is the user role required for the application as well as the access data of Business ID. The user’s surname/first name is made available here within the S24h App for Technicians.
  • The list of telephone numbers used for service is provided by the authorised service partner of Daimler Truck AG.

4. Legal Basis of the Processing
a. Provision of the S24h app for technicians
The legal basis for the processing of your personal data for the provision of the application is Art. 6 (1) lit. b GDPR.

b. Status, geolocation and service provided by the user
The legal basis for processing the user’s status, geolocation and service provision – in case of an active shift – as a prerequisite for case dispatch is Art. 6 (1) lit. f GDPR.

c. Further application options
In addition, we process personal data for the purposes of pursuing our legitimate interests as well as the legitimate interests of third parties in accordance with Art. 6 (1) lit. f GDPR. In particular for the following processing:

  • Maintaining the functionality of our IT systems
  • To improve our application
  • Creation of anonymised reports.
  • For security reasons, in particular to prevent and detect attacks on our app or attempts at fraud, we store the information and user data for a period of 30 days.

5. Recipients
Below is an overview of the corresponding recipients:

  • National sales organisations or general distributors deployed in the respective sales country
  • The authorised Daimler Truck Service Partner of the user of the application

Note: Your Daimler Truck Service Partner can provide you with the data protection information for the processing of your data beyond the application for the performance of the services such as the Roadside Assistance Service and Service24h.

To assist us in carrying out our business operations and to provide certain services and features, we may share personal data with service providers, including hosting service providers, customer service providers, Cloud services, content provisioning services, support and security monitoring services, email communications software, and other information technology providers. We conclude order processing agreements with our service providers in order to protect the data of our S24h App for Technicians users and to prohibit its disclosure to third parties.

Processors: Group companies or external service providers, for example in the areas of technical infrastructure, which are carefully selected and reviewed. The data processors may only use the data in accordance with our instructions.

6. Deletion of personal data/storage period
Your personal data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected.

a. Provision of the S24h app for technicians
Log files created during the connection to the S24h App for Technicians are deleted after 30 days.

b. Status, geolocation and service provided by the user
The availability status calculated depending on the shift is saved in order to be able to provide the service operation with availability reports (cf. dealer contract).

In the case of geolocation, only the last position transmitted during an active shift is displayed in the central system for case processing. Any further storage – particularly of historical data – will not take place.

The name and telephone number of the S24h App for Technicians user linked to the case as part of the case referral will be deleted after five years.

c. Further application options
Beyond this point in time, data is only stored if this is required by the laws, regulations or other legal provisions to which we are subject in the EU or by legal provisions in third countries, if an adequate level of data protection is ensured there. If deletion is not possible in individual cases, the corresponding personal data will be marked with the aim of restricting further processing.

7. Rights of the data subject
As a data subject, you have the right of access (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), right to erasure (Art. 17 GDPR), right to restriction of processing (Art. 18 GDPR) and the right to data portability (Art. 20 GDPR).

Right to objection

Under certain conditions, you have the right to object to the processing of personal data concerning you at any time for reasons arising from your particular situation or if personal data is used for direct marketing purposes, if the processing is based on the legal basis of Article 6 (1) lit. f GDPR. We will not longer process your personal data unless we can prove compulsory, legitimate reasons for processing that outweigh your interests, rights, and freedoms, or if this processing is required to assert, exercise, or defend against legal claims (Art. 21 GDPR).
